DigitalOcean Public Preview Terms: NVIDIA Nemotron Super 120B Inference Offering
Last Updated on March 16, 2026The below terms (the “Preview Terms”) apply to your participation in the public preview of, and your use of, the above identified DigitalOcean Service (the “Preview Offering”). The Preview Terms supplement the terms of the DigitalOcean Terms of Service Agreement or such other written agreement between you and DigitalOcean governing your use of our Services (our “Agreement”). The Preview Offering is a Beta Service for purposes of the Agreement, and terms not defined in these Preview Terms have such meaning otherwise defined in the Agreement. If there is a conflict between these Preview Terms and the Agreement, these Preview Terms will control solely with respect to the conflict relating to your use of the Preview Offering.
Subprocessor Disclosure: DigitalOcean uses Amazon Web Services, Cloudflare, and Traversal (located in the United States) as subprocessors to support delivery of the Preview Offering service. A current list of other DigitalOcean Service subprocessors is available here.
Your participation in the public preview and use of the preview offering is voluntary. If you do not accept these Preview Terms then you may not participate in the public preview.
1. Purpose and Scope
The Preview Offering provides access to a hosted inference endpoint for the NVIDIA Nemotron Super 120B model, a high-performance, open-weights large language model (LLM) designed for agentic AI and complex, multi-step reasoning. This offering is intended for testing, evaluation, and feedback purposes.
2. Public Preview Details
Preview Pricing: As specified in the Gradient AI Platform Pricing page during the preview period. DigitalOcean reserves the right to change pricing upon 30 days’ notice.
Support: No formal Technical Support or Service Level Agreements (SLAs) apply. Support is provided on a reasonable-effort basis during standard business hours (8:00 AM – 5:00 PM PT, Monday through Friday, excluding holidays).
Model Source: Powered by the NVIDIA Nemotron Super 120B model.
Regional Availability: Available in select data centers as indicated in the creation flow.
3. Third-Party Terms and Licenses
Your use of the Preview Offering is subject to the following third-party requirements:
Model License: The NVIDIA Nemotron Super 120B model is provided under the NVIDIA Nemotron Open Model License. You agree to comply with all terms therein.
Prohibited Uses and compliance: In addition to complying with the DigitalOcean Acceptable Use Policy, users are strictly prohibited from utilizing the underlying NVIDIA Nemotron models, their derivatives, or generated outputs for any purposes that violate applicable local, state, national, or international laws and regulations. Prohibited activities include, but are not limited to: the generation of content that promotes violence, sexual abuse, or hate speech; the facilitation of criminal activity or the creation of illegal weapons; and the development of malware, fraud, or deceptive practices. Any use of the Service in a manner that infringes upon the intellectual property rights of others is strictly forbidden.
Redistribution and Attribution. If you redistribute any portion of the model, its outputs, or derivative works, you must include a copy of the NVIDIA Nemotron Open Model License and the following attribution: “Licensed by NVIDIA Corporation under the NVIDIA Nemotron Model License.” You are prohibited from removing or altering any copyright, patent, trademark, or attribution notices included in the original model. If you modify the model or its source files, you must include prominent notices stating that the files have been changed to ensure the modifications are not misrepresented as original NVIDIA work.
