We only list agreement documents that have been updated in the particular month. If a document is not listed, no changes have been made to those terms in that month.
The GitHub SLA has been completely rewritten from the ground up, based on your feedback that our 2021 SLA was "dated" and significantly different from the Microsoft standard language customers expected.
Our new SLA now largely mirrors the Microsoft SLA, in both content and style. We have three SLA service tiers covering the same products from the prior edition. We also made clarifying edits in Section 3 regarding who to contact to request service credits, and clarified in Section 5(B) that the GitHub Enterprise Cloud service features covered by the SLA are actually part of GitHub Enterprise Cloud.
This June 2026 version of the GitHub SLA will apply to new customers and renewals beginning 1 June 2026. If your agreement uses the 2021 GitHub SLA and you need a copy for your records, please contact us.
At the top of the document, inserted a preamble noting that the terms are deprecated as of 5 March 2026 and new subscriptions will be governed by the GitHub Generative AI Services Terms. No other terms were changed.
This new document has an expanded scope to include all GitHub products that use generative AI, regardless of what the product is named. It replaces the GitHub Copilot Product Specific Terms for new subscriptions and renewals that take place beginning 5 March 2026 or later.
The commitments in the deprecated GitHub Copilot Product Specific Terms are included in these replacement terms. This document is not intended to limit any preexisting protections our customers had.
Section 4: moved Section 4(c) up to become Section 4(a), and updated the other section references accordingly
Section 4(a): In the first sentence, inserted the words "By default" at the beginning of the sentence and "and follows the terms below" at the end
Section 4(a): Inserted three new sentences providing for DPA coverage of certain pre-release software
Section 2(A)(ii): In the first sentence, inserted "unless expressly designated by GitHub as being governed by this DPA."
Section 2(A)(ii): In the second sentence, deleted "which" and replaced with "Previews", and inserted the word "are" before "offered"
Section 2(a): In the first sentence, inserted "for evaluation and testing"
Section 2(a): In the second sentence, inserted "This means" at the beginning, "evaluate its functionality and internally" in the middle, and "for evaluation but not external distribution" at the end
Section 2(a): In the last sentence, inserted the word "internally" in the middle, and the clause after the comma at the end
Section 10: Deleted the entire section previously labeled "No Indemnity" and replaced with the current section labeled "Defense of Third Party Claims"
Section 12: At the end of the section, inserted "This limit will not apply to the defense obligations in Section 10."
